PLEASE READ THESE TERMS CAREFULLY. By downloading, accessing, or using the KST Futbol World Cup Predictor mobile application (the “App”), you agree to be bound by these Terms and our Privacy Policy (together, the “Agreement”). If you do not agree, do not use the App.

1) Definitions

  • “App” means the KST Futbol World Cup Predictor Android application, including updates and related services.
  • “Content” means text, graphics, models, simulations, projections, predictions, probabilities, and any other materials displayed in the App.
  • “Predictions/Probabilities” include match and tournament projections and any “scoreline probabilities” or similar outputs, whether free or Premium.
  • “Premium” means a one-time purchase that unlocks additional functionality (e.g., detailed scoreline probabilities).
  • “Third-Party Services” include ad networks (e.g., Google AdMob), app stores/billing, analytics, crash reporting, and other SDKs or services.

2) Eligibility and Global Use

2.1 General Audience; Minors. The App is intended for a general audience and may be used by people of any age. If you are under the age of majority in your place of residence, you may use the App only with the permission and, where appropriate, the supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

If you (or your parent/guardian on your behalf) are not legally permitted to consent to the processing of personal data under applicable law (for example, certain rules may apply to users under 13 in the United States and under 16 (or a lower age set by a country, typically not below 13) in the EEA/UK), a parent or legal guardian must provide any required consent, and we may limit or disable certain features (such as personalized advertising, analytics, or other data-dependent features) to comply with applicable law and platform requirements.

Premium purchases and other transactions are handled by the app store and generally require an adult account holder. Parents/guardians are responsible for supervising and managing in-app purchases and device/app store controls.

2.2 Global Availability. The App may be used worldwide, including the United States and Europe. You are responsible for ensuring that your use of the App is lawful in your jurisdiction and for complying with all applicable laws, rules, and regulations (including any age-related requirements). Certain features, content, languages, or functionality may vary by region, device, or app version, and may not be available everywhere.

3) Nature of the App: Entertainment/Informational Only — NO Gambling

3.1 Not a sportsbook / no wagering. The App is for entertainment and informational purposes only. The App:

  • is not a gambling product, sportsbook, bookmaker, casino, or betting intermediary;
  • does not accept, facilitate, or process wagers;
  • does not encourage or promote gambling.

3.2 No betting advice. Nothing in the App constitutes betting advice, financial advice, or any professional advice. Any reliance on the App is at your own risk.

4) Predictions Are Estimates — No Guarantee of Accuracy

4.1 No accuracy guarantees. Predictions/Probabilities are inherently uncertain and may be wrong. Outputs may change due to incomplete data, model assumptions, injuries, lineups, tournament rules, real-world events, source limitations, or technical errors.

4.2 User responsibility for decisions. You are solely responsible for any decision you make based on the App. KemsorTech is not responsible for any interpretation, action, or outcome resulting from your use of the App (including any third-party wagering or financial decisions you choose to make independently).

5) Premium (One-Time Purchase)

5.1 Billing handled by the store. Premium purchases are processed through Google Play Billing (or the store applicable to your device/region). Your purchase is also subject to Google Play’s terms and policies.

5.2 What Premium provides. Premium unlocks additional features such as detailed scoreline probability information and other enhanced analytics described in the App at the time of purchase. Features may evolve over time.

5.3 No guarantee of results. Premium does not guarantee prediction accuracy, outcomes, winnings, or any particular performance.

5.4 Restores and device changes. If the App includes “Restore Purchases,” restoration is subject to store verification and your compliance with the store’s requirements.

5.5 Refunds. Refunds are governed by Google Play’s refund policies and applicable law. Unless required by law or store policy, all sales are final.

5.6 EU/EEA/UK Digital Content Notice. Where applicable, if you request immediate access to digital content/services after purchase, you acknowledge that statutory withdrawal rights may be limited or waived under local consumer rules (as implemented by the app store purchase flow), to the extent permitted by law.

6) Ads and Third-Party Advertising (AdMob)

6.1 Ads. The App may display ads provided by Google AdMob and/or other ad partners. Ads may be contextual or, where permitted and enabled, personalized.

6.2 Third-party data processing. Ad providers may process device identifiers, ad identifiers, approximate location signals, IP address, ad interactions, and fraud-prevention signals as described in our Privacy Policy and the third party’s own policies.

6.3 No responsibility for ads. We do not control and are not responsible for third-party advertising content, offers, websites, or services linked from ads.

7) Privacy

Your use of the App is subject to our Privacy Policy: [INSERT PRIVACY POLICY LINK].
If there is a conflict between these Terms and the Privacy Policy regarding personal data, the Privacy Policy controls.

8) License and Acceptable Use

8.1 Limited license. We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for personal, non-commercial purposes in accordance with these Terms.

8.2 Prohibited conduct. You agree not to:

  • reverse engineer, decompile, disassemble, or attempt to derive source code, models, or algorithms (except to the extent permitted by law);
  • modify, tamper with, or interfere with App functionality, results, security, or integrity;
  • use bots/scrapers or automated access to extract data or overload the App;
  • use the App for illegal activity, fraud, or to infringe the rights of others;
  • circumvent paywalls, Premium entitlements, or access controls.

8.3 Enforcement. We may investigate, suspend, or terminate access if we reasonably believe you violated these Terms or harmed the App, users, or third parties.

9) Intellectual Property

The App and all Content, including designs, logos, trademarks, models, simulations, and text, are owned by or licensed to KemsorTech LLC and protected by intellectual property laws. You may not copy, distribute, sell, sublicense, or create derivative works without our prior written consent.

10) No Affiliation Disclaimer (Important)

KST Futbol World Cup Predictor is an independent product and is not affiliated with, sponsored by, endorsed by, or associated with FIFA, tournament organizers, teams, leagues, players, or any rights holders. Any references to tournament names, schedules, teams, or trademarks are for identification/informational purposes only and belong to their respective owners.

11) Service Availability, Updates, and Changes

11.1 No guaranteed uptime. The App may be unavailable due to maintenance, outages, device limitations, network issues, or events beyond our control.

11.2 Changes. We may modify, update, or discontinue any part of the App (including Premium features) at any time, to the extent permitted by law.

11.3 Compatibility. We do not guarantee compatibility with all devices, OS versions, or regions.

12) Disclaimer of Warranties (“AS IS” / “AS AVAILABLE”)

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR AVAILABILITY.
WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

13) Limitation of Liability

13.1 Exclusion of damages. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEMSORTECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE APP OR PREMIUM, INCLUDING ANY RELIANCE ON PREDICTIONS/PROBABILITIES OR ANY THIRD-PARTY DECISIONS (INCLUDING WAGERING) YOU MAKE.

13.2 Aggregate liability cap (ALL USERS TOTAL). TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL, AGGREGATE LIABILITY OF KEMSORTECH LLC TO ALL USERS COLLECTIVELY, FOR ALL CLAIMS OF ANY KIND ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS, SHALL NOT EXCEED TWENTY U.S. DOLLARS (USD $20) IN THE AGGREGATE (“Aggregate Cap”), REGARDLESS OF THE FORM OF ACTION (CONTRACT, TORT, OR OTHERWISE) AND REGARDLESS OF THE NUMBER OF CLAIMS OR CLAIMANTS.

13.3 Mandatory rights / enforceability fallback. Some jurisdictions do not allow certain limitations of liability, especially for consumers, or do not allow liability limits to be set as low as the Aggregate Cap. To the extent any part of this Section is unenforceable, KemsorTech’s liability will be limited to the maximum extent permitted by applicable law, and any unenforceable portion will be modified to the minimum extent necessary to make it enforceable while preserving our intent to limit liability as broadly as legally possible.

13.4 No exclusion for non-waivable liability. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (for example, certain liabilities for intentional misconduct, or where consumer law provides non-waivable rights).

14) Indemnification

You agree to defend, indemnify, and hold harmless KemsorTech LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • your use of the App or Premium;
  • your violation of these Terms or applicable law;
  • your misuse of Predictions/Probabilities (including any wagering decisions you make independently);
  • your infringement of third-party rights.

15) Termination

We may suspend or terminate your access to the App or Premium if you violate these Terms, if we suspect fraud or abuse, or if required for security or legal compliance. You may stop using the App at any time. Sections that by their nature should survive termination (e.g., IP, disclaimers, limitation of liability, indemnity) will survive.

16) Governing Law and Venue (All U.S. States + Global Consumers)

You requested “all states,” so this is written to reflect that:

16.1 United States users — state law may apply. If you reside in the United States, these Terms are governed by applicable U.S. federal law and the laws of the U.S. state in which you reside, without regard to conflict-of-law principles, to the extent permitted.

16.2 Non-U.S. users — local mandatory rights. If you reside outside the United States (including the EEA/UK), your local mandatory consumer protection laws may apply and nothing in these Terms is intended to limit those mandatory rights.

16.3 Venue. Except where prohibited by applicable consumer law, any dispute will be brought in courts located in the United States, and you consent to personal jurisdiction there. Where consumer law grants you the right to bring claims in your country or region of residence, those rights remain unaffected.

17) Changes to These Terms

We may update these Terms from time to time to reflect changes in the App, law, or our practices. We will update the “Last Updated” date above. Continued use of the App after changes means you accept the updated Terms to the extent permitted by law.
